Raleu Design – 2024
1. Agreement, Offer, and Confirmation
1.1 These General Terms and Conditions govern all offers, sales, and the execution of orders placed by clients through the Raleu Design website as well as all traditional interactions involving custom design work and other services provided directly by Raleu Design, referred to as the “Designer”.
1.2 Offers are without commitment, valid for two months, with prices subject to change due to unforeseen work changes, exclusive of VAT.
1.3 Orders are confirmed via the website’s automated system. By placing an order and completing the checkout process, the client agrees to these General Terms and Conditions.
2. Product Information, Performance of Agreement, and Shipping
2.1 Efforts are made to display product colors and images accurately. All products are subject to availability, and we reserve the right to limit sales and discontinue products.
2.2 The Designer will fulfill orders accurately, expecting the client to provide complete, sound, and clear information necessary for order fulfillment.
2.3 Shipping terms are processed within the specified days, and Raleu Design is not liable for third-party carrier delays.
3. Cancellations, Returns, and Refunds
3.1 Clients may cancel orders within a specified period unless they are personalized or made to order. Returns in original condition must be made within 14 days of receipt.
3.2 Refunds are processed upon return inspection, excluding shipping costs. Complaints about damaged or incorrect items must be reported within ten business days for resolution.
4. Intellectual and Other Property Rights
4.1 Raleu Design holds all intellectual property rights to designs, including but not limited to postcards, art prints, and notebooks. Any use of these designs beyond personal use requires explicit permission.
4.2 Intellectual property rights arising from custom work are detailed, with rights possibly being transferred under specific conditions documented in writing.
5. Engagement of Third Parties and Third Party Products
5.1 Instructions to third parties in the context of commissioned work are given by or on behalf of the client unless otherwise agreed.
5.2 The Designer is not liable for errors or defects in third-party products or services engaged by the client.
6. Fees, Payments, and Additional Costs
6.1 The Designer is entitled to a fee for the commissioned work and reimbursement of incurred costs, with additional work caused by delays or changes being charged separately.
6.2 Payments are due within 30 days of the invoice date, with overdue payments attracting statutory interest and collection costs.
7. Use of the Result
7.1 Once obligations under the agreement are fulfilled, the client acquires the right to use the results in accordance with the agreed purpose, limited to the scope of the commission unless broader use is agreed upon.
8. Dispute Resolution and Legal Compliance
8.1 Any disputes will be governed by Dutch law, with efforts made to resolve disputes in consultation prior to legal proceedings.
